Terms of Sale for International Customers

Effective date: 9th April 2026

Important notice

These Terms of Sale are provided for the convenience of international customers purchasing from EQCLUSIVE DISTRIBUTION MARTA KOTONSKA through www.eqclusive.com.

The Polish version of the store regulations, available on our website as Regulamin sklepu, remains the primary legal version governing sales conducted by EQCLUSIVE DISTRIBUTION MARTA KOTONSKA. In the event of any inconsistency, the Polish version shall prevail to the fullest extent permitted by law.

Nothing in these Terms excludes or limits any mandatory consumer rights that may apply under the laws of your country of residence where such rights cannot lawfully be excluded.

Throughout these Terms, “Eqclusive”, “we”, “us” and “our” refer to EQCLUSIVE DISTRIBUTION MARTA KOTONSKA.

2. Scope of these Terms

These Terms apply to orders placed through www.eqclusive.com by customers outside Poland.

They govern the sale of products offered through our website, including the process of placing an order, payment, dispatch, delivery, cancellations, returns, and complaints.

By placing an order through our website, you confirm that you have read and accepted these Terms.

3. Our products

We make every effort to ensure that product descriptions, images, colours, and specifications shown on our website are presented as accurately as possible.

However, product images are for illustrative purposes only. Colours may vary depending on screen settings, lighting, manufacturing batches, or natural material variation.

We reserve the right to amend product descriptions, specifications, availability, and pricing at any time without notice, provided that such changes will not affect any order already accepted by us.

4. Placing an order

Orders may be placed through our website 24 hours a day, subject to technical availability.

To place an order, you must:

  • select your chosen products
  • add them to your basket
  • enter the required billing and delivery details
  • select your preferred delivery and payment method
  • confirm the order by completing the checkout process

When you place an order, you are making an offer to purchase the products selected.

Once your order has been placed, you will receive an automatic email confirming that we have received it. This email is an acknowledgement only and does not mean that your order has been accepted.

A contract for sale is formed only when we send you a separate email confirming that your order has been accepted for dispatch.

5. Order review and acceptance

We reserve the right to contact you before accepting your order where reasonably necessary, including where:

  • delivery details are incomplete or unclear
  • a product is unavailable
  • a pricing or technical error has occurred
  • the shipping charge generated at checkout appears clearly inaccurate or excessive
  • the order cannot be fulfilled as placed

Where the shipping rate shown at checkout appears unusually high, we may invite you to contact us at kontakt@eqclusive.pl with:

  • a screenshot of your basket
  • your full name
  • your full delivery address
  • your email address
  • your phone number

Where possible, we may then prepare a custom checkout with a more accurate shipping rate.

We reserve the right to decline any order before acceptance, in which case any payment received will be refunded.

6. Prices and payment

All prices shown on our website are displayed in the relevant currency shown at the time of browsing and include VAT or other applicable taxes only where clearly stated.

Shipping charges are calculated separately at checkout unless expressly stated otherwise.

Payment must be made in full at the time of placing the order using one of the payment methods made available at checkout.

Payments are processed securely by authorised third-party payment providers. We do not store full payment card details on our own systems.

If payment is not successfully completed, the order will not be processed.

7. Shipping and fulfilment

At Eqclusive, we operate across two fulfilment locations: Poland and the United Kingdom.

For full clarity, most of our stock is held in Poland, and the majority of orders are therefore dispatched from our Polish fulfilment centre. Our own Eqclusive product ranges are primarily shipped from Poland.

Selected items may occasionally be dispatched from the United Kingdom, depending on stock availability and operational requirements.

Where an order includes products held in different fulfilment locations, it may be shipped in separate parcels. If this happens, parcels may arrive separately and on different timelines.

8. Dispatch times

We aim to dispatch accepted orders within 1–3 working days of receiving cleared payment.

Dispatch times may be slightly longer during peak trading periods, product launches, promotional events, public holidays, or where additional review is required before shipment.

Once your order has been dispatched, you will receive confirmation by email together with tracking details where applicable.

9. Delivery estimates

Any delivery times shown on our website, at checkout, or in order communications are estimates only.

They are not guaranteed delivery dates.

Transit times may vary depending on destination, customs processing, local courier performance, weather conditions, seasonal pressures, transport disruption, or other matters outside our control.

10. Customs duties, import taxes and additional charges

For international orders, customs duties, import taxes, clearance charges, handling fees, brokerage fees, and any other import-related costs are not collected by us upfront unless explicitly stated otherwise at checkout.

Where such charges apply, they are the responsibility of the customer.

Eqclusive has no control over customs authorities, import regulations, local procedures, or charges applied by the destination country. We therefore strongly recommend that customers familiarise themselves with local import rules before placing an order.

We are not responsible for delays caused by customs clearance, import inspections, local authority procedures, or courier processing once the parcel has arrived in the destination country.

11. Additional shipping charges

Although our checkout system is designed to calculate shipping automatically, we reserve the right to contact you before dispatch if an order requires an additional shipping payment due to circumstances such as:

  • oversized parcels
  • heavier consignments
  • remote or surcharge delivery areas
  • specialist courier handling requirements
  • multi-parcel fulfilment requirements not accurately reflected at checkout

If this applies, we will contact you before dispatch. If you choose not to proceed, your order may be cancelled and refunded before shipment.

12. Delivery address and failed delivery

It is your responsibility to ensure that all delivery information provided at checkout is complete and accurate.

We are not responsible for delays, failed deliveries, returned parcels, or additional charges arising from:

  • incorrect or incomplete delivery details
  • omitted apartment, unit, house or access information
  • refusal of delivery
  • failed delivery attempts
  • failure to collect a parcel from a depot, locker or collection point
  • failure to respond to courier or customs communications

If a parcel is returned to us for any of these reasons, any re-shipping costs will be payable by you.

13. Risk and title

For consumers, the risk of loss or damage to products passes to you when the goods are delivered to you or to a person identified by you to receive them, unless you appoint your own carrier not offered by us.

Ownership of the goods passes to you once full payment has been received and the goods have been delivered.

14. Right to cancel and return

If you are purchasing as a consumer, you may have the right to cancel your order within 14 days of receiving the goods, unless an exception applies under applicable law.

To exercise your right to cancel, you must notify us by a clear written statement sent to kontakt@eqclusive.pl before the cancellation period expires.

You must return the goods to us without undue delay and no later than 14 days after informing us of your decision to cancel.

Unless we agree otherwise, you are responsible for the direct cost of returning the goods.

We will refund all payments received from you for the cancelled goods, including the standard cost of outbound delivery where required by law, no later than 14 days after we receive your cancellation notice. We may withhold reimbursement until we have received the returned goods or you have provided satisfactory proof of return, whichever occurs first.

You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

15. Exceptions to cancellation rights

The right to cancel does not apply where goods fall within a lawful exception, including but not limited to:

  • products made to your specification or clearly personalised
  • sealed products which are unsuitable for return for health or hygiene reasons once unsealed
  • goods liable to deteriorate or expire rapidly
  • any other goods for which cancellation rights are lawfully excluded

16. Faulty, damaged or non-conforming goods

We take quality seriously. If you believe that goods received are faulty, damaged, incorrect, or otherwise not in conformity with your order, please contact us as soon as possible at kontakt@eqclusive.pl.

To help us assess the issue promptly, please include:

  • your order number
  • a description of the issue
  • clear photographs where relevant
  • your preferred resolution

Where required by applicable law, we will provide a suitable remedy, which may include repair, replacement, price reduction, or refund, depending on the circumstances and the legal rights available to you.

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws.

17. Returned parcels and refused customs charges

If an order is returned to us because customs charges were refused, the parcel was unclaimed, delivery could not be completed, or you failed to comply with courier or customs requirements, we reserve the right to deduct from any refund:

  • the original outbound shipping cost
  • any return shipping charges incurred
  • any customs, clearance, handling or brokerage charges imposed on the return
  • a reasonable administrative charge where applicable

Any refund will only be processed once the parcel has been received back and inspected by our team.

Please note that international returns of this nature may take a considerable amount of time to reach us.

18. Promotions and discount codes

Only one discount code or promotional code may be used per order unless expressly stated otherwise.

Discount codes are valid only for online orders and may be subject to stock availability, product restrictions, minimum spend requirements, or other promotional conditions.

Discount codes may not be used in conjunction with any other offer unless expressly stated otherwise.

We reserve the right to refuse, cancel, amend, or withdraw any promotional code or offer at any time where reasonably necessary, including where a code is used incorrectly, unlawfully, fraudulently, or in breach of these Terms.

Where goods purchased using a discount are returned, any refund will reflect the amount actually paid at the time of purchase, not the full recommended retail price.

19. Intellectual property

All content on this website, including text, product descriptions, images, graphics, branding, trade names, logos, designs, and other materials, is owned by or licensed to Eqclusive or the relevant rights holder.

No part of the website or its content may be copied, reproduced, republished, distributed, or used for commercial purposes without prior written permission.

20. Privacy and personal data

We process personal data in accordance with applicable data protection law and our Privacy Policy.

Your information is used only as necessary to process payment, fulfil and deliver your order, provide customer service, handle returns or complaints, and comply with legal obligations.

21. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any mandatory consumer rights.

Subject to the above, we are not liable for indirect or consequential loss, or for delays or failures caused by circumstances beyond our reasonable control.

22. Governing law

These Terms and any contract between you and Eqclusive shall be governed by Polish law, except where mandatory consumer protection provisions of your country of residence apply and cannot lawfully be excluded.

23. Changes to these Terms

We may update these Terms from time to time for legal, operational, or commercial reasons.

Any changes will apply only to orders placed after the updated version has been published on our website.

The version in force at the time you place your order will apply to that order.
